And in order to adopt children, there are certain legal formalities that need to be completed, only then a child can be adopted and taken outside of Bangladesh in due process. It is to contend that without prior permission from the respected authorities, such adoption shall not see the light of legal acquiescence and would be considered as a pure infringement of the adoption law in Bangladesh, that shall ultimately render serious punishment. 

Legal Requirement to Obtain Guardianship Title

At first, it is needed that the guardians obtain some necessary documents from the country they are residing. Next, from Bangladesh, the child may be adopted usually from orphanages. And in order to proceed for adoption, the authority responsible for granting legal guardianship is the Family Court from where the guardianship order needs to be obtained. Once the prospective adoptive parents have been matched with a child, an application must be submitted for legal guardianship to the Family Court having jurisdiction over the child’s place of residence and the Court, after reviewing the application and subject to legal conditions being fulfilled, issues a guardianship order. 

 

After guardianship is being awarded, it is required to obtain Post-guardianship Birth Certificate. This is important for obtaining further permission in order to complete the adoption procedure. Later the guardians and the child needs to Obtain a No Objection Certificate (NOC) from the Ministry of Home Affairs and of course before leaving Bangladesh passport of the child is required along with a valid visa. The last stage of the process takes place in the country of residence of the adoptive parents when the child is legally adopted according to the adoption laws of the country.
